COURT OF PROTECTION

The Court of Protection is used when a conflict arises between views of those looking after a 'protected' party.

This can traverse different types of law, and the COP team at Charterhouse Chambers works in the Court of Protection in both family and civil law in particular. 

Our team can provide representation and advice in matters including Welfare, Finances, Medical Treatment Decisions and Deprivation of Liberty in conference and at round table meetings as well as at court. Charterhouse barristers represent individuals, Local Authorities and the Official Solicitor.

Charterhouse barristers understand that being involved in a COP case can seem a daunting and confusing prospect.

Whether you are an individual protecting the interests of a loved one or working for a Local Authority the burden of seeking to protect the best interests of another may seem daunting.

Our barristers aim to help simplify the whole Court of Protection process and help lift that burden by comprehensively advising and ensuring that you are fully involved in best-interest decisions.

Early involvement including drafting paperwork and giving robust practical advice at an early stage is seen as essential.

All of our COP team are available to give advice and drafting from the very earliest stages of the COP process and aim to see the case through to any final hearing or follow-up hearings as required.

We also have experience of assisting in the financial management of high-value damages or settlements managed by the Court of Protection.

We welcome enquiries at all stages and our barristers are happy to give formal or informal advice at short notice.

We also fully appreciate the necessity for swift turnaround of paperwork [threshold or framework] within days, and round-table meetings are accommodated quickly.

PUBLIC ACCESS

The Public Access scheme allows members of the public and companies to instruct a barrister directly without the need of a solicitor. To check that you may be able to instruct a barrister directly and to obtain a quotation for the legal service that you require please contact a barrister or clerk at Charterhouse who will be glad to help.

Once you have contacted a barrister or a clerk in chambers there will be an assessment of your case initially by a barrister at no cost to ascertain the best way forward.

Charterhouse barristers charge by either fixed fee or hourly rate depending on the type of work to be done.

For example for advising in writing or in conference our barristers charge between £150 plus vat per hour and £350 plus vat per hour depending on the value and complexity of the case, the scale of the work to be done including preparation time, and the seniority of the barrister instructed.

If you have a court hearing to attend and require a barrister to represent you we will propose a fixed-fee plus vat for that attendance.

There will be no obligation to pay any fees until you agree to proceed and either wish the barrister to commence work on your case, or due to time constraints the barrister needs to commence.

Charterhouse barristers are able to deal with civil, criminal and family cases in this way if you are not entitled to Legal Aid.
